But swimming pools aren’t banned. They’re highly regulated. To install a pool in my backyard, I need to file for a permit, pass multiple inspections, use approved contractors, install a security fence with a specific lock, hang signage, register with my city, and keep it locked at all times.

If my negligence such as forgetting to lock it or not repairing a damaged fence leads to a toddler wandering back there and drowning, I go to prison under established nuisance laws. Even if the toddler was unsupervised. Even if the toddler went onto my property.
